JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-02-2018 The petitioner seeks bail in anticipation of his arrest in connection with Tariyani Chhapra P.S. Case No. 25 of 2017 dated 14.11.2017 instituted for the offence under Sections 30(a), 33 of the Bihar Prohibition and Excise Act, 2016. On secret information that liquor is being carried by two miscreants, a raid was conducted in which one of the persons was arrested. He has disclosed the name of the petitioner. On the indication of the arrested person, 48 bottles of Indian made foreign liquor were recovered from a brinjal field. It has been submitted on behalf of the petitioner that name of the petitioner has only transpired on the statement of the co-accused who was arrested by the police on raid. Nothing has been recovered from his possession and he bears clean

For the facts aforesaid, the petitioner, above named is directed to be released on bail, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to his furnishing bail bond in the sum of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum Special Judge, Sheohar in connection with Tariyani Chhapra P.S. Case No. 25 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
