Petitioners pray for grant of bail in Town P.S. Case No. 315 of 2021, registered for the offence under Sections 363, 366(A), 34 of the Indian Penal Code.

As per the prosecution case, these petitioners alongwith other FIR named co-accused persons kidnapped the minor daughter of the informant for the purpose of marriage. It is submitted on behalf of petitioners that thrust of the accusation is against co-accused Abhishek Kumar and petitioners have been made accused in this case only due to the fact that petitioner no. 1 is his father, whereas petitioner no. 2 & 3 are his (Abhishek Kumar) brothers. It is further submitted that

Patna High Court CR. MISC. No.64067 of 2021(2) dt.22-02-2022 2/2 after recovery of victim girl, her statement was recorded under Section 164 Cr.P.C., wherein she has not stated any wrong against these petitioners. Petitioners are in custody since 14.05.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Town P.S. Case No. 315 of 2021.
