JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 272, 273, 420 and 120B of the Indian Penal Code and Sections 30(a), 38 and 41 of Bihar Prohibition and Excise Act, 2016.

From a truck liquor was recovered. Allegation is that the petitioner was escorting the said truck on a car. Submission is that the accused persons, who were on the truck, have already been allowed bail in this case such as driver Ashok in Cr.Misc.No.8276 of 2017 and co-accused Yogendra Yadav by a co-ordinate Bench of this Court in Cr.Misc.No.7043 of 2017.

Patna High Court Cr.Misc. No.14388 of 2017 (2) dt.29-03-2017 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West, Muzaffarpur/Successor Court, in connection with Saraiya P.S. Case No. 385 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
