The petitioners seek bail in Gaighat P.S. case No. 33 of 2015 under Section 304B, 201/34 of the Indian Penal Code. The informant alleged that Phulkumari Devi was killed by her husband and other in-laws. The informant informed the police and half burnt dead body of the deceased was found and recovered from cremation ground.

The learned counsel for the petitioner submits that petitioners are brothers-in-law and father-in-law of the deceased. Tara Mohan @ Tara Mohan Ram, one of the brother-in-law of the deceased, has already been granted bail vide order dated 03.03.2016 passed in Cr. Misc. No. 54796 of 2015.

No.12491 of 2017 (3) dt.16-05-2017 2/2 It appears that petitioners are brothers-in-law and father-in-law of the deceased and no specific allegation of demand of dowry or torture is made against the petitioners. Similarly situated accused Tara Mohan @ Tara Mohan Ram has already been granted bail.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-X, Muzaffarpur in Sessions Trial No. 88 of 2016, arising out of Gaighat P.S. Case No. 33 of 2015.
