JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Murliganj P.S. Case No. 249 of 2016 registered under Sections354, 379 & other minor sections of the Indian Penal Code. It appears that except Sections-354 & 379, almost all the sections are bailable in nature and so far as Sections-354 & 379 are concerned; it is argued that the aforesaid sections have been inserted in the present case with a view to make the offence graver and serious. It is further submitted that as a matter of fact, a hot exchange of words had taken place between the parties on account of grazing the field of the petitioner by the goat of the informant but the informant lodged the present case with a

Considering the above-said facts and circumstances of the case as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Murliganj P.S. Case No. 249 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Madhepura subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
