13-02-2018 Heard Mr. Md. Najmul Hodda, learned counsel for the petitioner and Smt. Rita Verma, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Shambhuganj P.S. Case No. 160 of 2017 registered for offence under Sections 406, 420, 120B/34 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender. Learned counsel for the petitioner submits that prior to lodging the present F.I.R., from the petitioner's side an F.I.R., vide Kotwali P.S. Case No. 731 of 2017, was registered on 11-10-2017, in which, it was alleged that his bag containing cheque-book was stolen and he apprehended that the accused person may commit any offence.

Besides hearing, I have perused the material on record, particularly the F.I.R. and after going through the same, it is

No.7375 of 2018(2) dt.13-02-2018 2/2 evident that the cheque of Rs. 1,00,000/- (one lac) issued in the name of one Akshay Enterprises, of which, petitioner was proprietor, by making interpolation, an amount of Rs. 21,00,000/- (twenty one lacs) was withdrawn. Since in the F.I.R., there is specific accusation against the petitioner, I do not find any ground to extend the privilege of anticipatory bail. Dismissed.
