JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-11-2015 Heard learned counsel for the petitioners. Despite repeated calls none appears on behalf of the State. The petitioners seek pre-arrest bail in connection with Pakridayal P.S. Case No.129 of 2014 registered under Sections 341, 323, 354(a), 354(b), 364 and 506/34 of the Indian Penal Code.
It is contended that there is an unexplained and inordinate delay of seven days in institution of the FIR. Even otherwise, the main allegation is against Arbind Singh and Maheshwar Singh.
Taking into consideration the nature of allegation, in the event of arrest or surrender in the court below within six weeks
Patna High Court Cr.Misc. No.50476 of 2015 (2) dt.05-11-2015 2/2 from today, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahana, Motihari in connection with Pakridayal P.S. Case No.129 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
