At the very beginning, learned counsel appearing on behalf of the BISCOMAUN has raised a preliminary objection that this application under Article 226 of the Constitution of India is not maintainable, in view of the Special Bench decision of this Court in case of the Organizer Dehri C.B. & C.M. Union Limited, Fazulganj, Sasaram Vs. State of Bihar & ors reported in 2014 (1) PLJR 695.
I find substance in the said preliminary objection.
Patna High Court CWJC No.18286 of 2015 (2) dt.10-05-2016 This application is, accordingly, dismissed as not maintainable.
It goes without saying that the petitioner shall have the liberty to approach appropriate forum for the reliefs claimed in the writ application.
