2. The petitioners apprehend their arrest in a case registered for the offence under Sections 26(2), 115(2), 109, 351(2), 352, 303(2) and 3(5) of the Bhartiya Nyaya Sanhita.
3. As per F.I.R., petitioner no. 1 assaulted Bhairav Mishra with Farsa and petitioner no. 2 assaulted Banshidhar Mishra with Gadasa, whereas petitioner no. 3 snatched cash of Rs. 3200/- from the pocket of informant.
4. Learned counsel for the petitioners submits that injuries, sustained by injured persons, are simple in nature. Case and counter case. Petitioner no. 1 & 2 have got clean antecedent,
Patna High Court CR. MISC. No.56223 of 2025(2) dt.02-09-2025 2/2 whereas petitioner no. 3 has got one criminal antecedent, in which, he is on bail.
5. Learned counsel for the informant vehemently opposed the bail petition.
6. Considering the nature of injury and the fact that there is case and counter case, the prayer for anticipatory bail of petitioners is allowed.
7. Let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Raghunathpur P.S. Case No. 143 of 2025, subject to condition as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
