JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-03-2022 Heard Mr. Manoj Kumar, learned counsel for the petitioner and learned AC to GP -5 for the State. The petitioner is no. 1 contractor and is registered with various departments of the State of Bihar and on the request of the petitioner and after considering the threat perception of the petitioner special security committee under the Chairmanship of A.D.G. (Security), Bihar recommended for deployment of one bodyguard with the petitioner on payment basis for a period of six months.

Learned counsel for the petitioner submits that petitioner is having threat perception but despite application for extension of tenure of bodyguard having been filed by the petitioner, the same has been rejected by the authority concerned on the ground that the petitioner did not mention in his

Learned counsel for the State relying on Annexure -E of the counter affidavit submits that bodyguard deployed with the petitioner has been recalled on the ground that the petitioner had taken the bodyguard outside the State without any permission and further in his application for extension of tenure of bodyguard the petitioner did not mention any specific threat perception.

I have heard learned counsel for the parties and taking into consideration the rival submissions, the present writ application is disposed of with liberty to the petitioner to file fresh application for deployment of bodyguard on payment basis based upon specific threat perception, and if such an application is filed by the petitioner, the concerned authority and / or the Committee shall consider the application of the petitioner in accordance with law and shall take a final decision within a period of two months from the date of filing of application. The writ petition stands disposed of.
