====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 07-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Raj Nagar P.S. Case No.76 of 2004 registered under Sections 306 and 201/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the written report of Rajendra Paswan, Chowkidar, that he is not an eye witness to the occurrence rather he came to know that due to harassment by her husband and in-laws, the deceased Rubi Devi, consumed poison and, thereafter, she started vomiting and she was wreathing but she was not taken for treatment and she died and her dead body

Patna High Court Cr.Misc. No.5965 of 2017 (5) dt.07-04-2017 2/2 was disposed of. Further submission is that the petitioner is the brother-in-law of the deceased and has falsely been implicated in this case. Moreover, on investigation, the police has submitted chargesheet under Section 306 of the Indian Penal Code. The petitioner is in custody since 25.09.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Madhubani, in connection with Raj Nagar P.S. Case No.76 of 2004.
