JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 341/323/307/363/366A/34 of the Indian Penal Code.

Allegation is of kidnapping of the daughter of the informant.

Submission is that the victim girl in her statement under Section 164 Cr.P.C. stated that co-accused Suman, who is son of the petitioner, had proposed for marriage and the learned advocate who called for consultation informed that the girl is minor, hence, marriage could not be performed. Considering the statement of the victim girl,

Patna High Court Cr.Misc. No.13340 of 2017 (2) dt.22-03-2017 2/2 which indicates that the matter is of love-affairs and there is no allegation of kidnapping, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/Successor Court, in connection with Hajipur Town P.S. Case No.706 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
