====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2018 The petitioner is apprehending his arrest in connection with Kudra P.S. Case No. 207 of 2017, registered for offences punishable under Sections 409 and 420 of the Indian Penal Code. Allegation against the petitioner is of misappropriation of total 270 quintals of CMR worth Rs. 5,13,845.10/- and out of this petitioner has only deposited Rs. 50,000/- and rest of amount i.e. Rs. 4,63,845.10/- has not been deposited causing loss to Government.

It has been submitted on behalf of the petitioner that petitioner has already deposited the amount in question, which will appear from Annexure 5, however when confronted by learned counsel for the B.S.F. C. with regard to the fact that a wrong entry has been made as name of the petitioner has been

Patna High Court Cr.Misc. No.9400 of 2018 (4) dt.12-04-2018 2/2 mentioned in place of other person showing the payment of CMR, for which the notice has also been sent to the petitioner, learned counsel for the petitioner agreed to pay the questioned amount if some time is provided to him.

Accordingly, this application is disposed of with direction to the petitioner to surrender before the court below within a period of six months along with a bank guarantee of Rs. 4,63,845.10/- , drawn in favour of the BSFC, which shall be verified by the court below and after verification, he shall release the petitioner on bail to the his own satisfaction otherwise he is free to pass any order as he deems fit and proper. Let no coercive steps be taken against the petitioner for a period of six weeks from today.
