JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 370 of the Indian Penal Code and Section 16 of the Bonded Labour System (Abolition) Act. Accusation is that the petitioner and others were allegedly found carrying children to Mumbai for their trafficking. Submission is that, in fact, the children were being carried for labour purpose, which is also an illegal act. However, the petitioner has got no criminal antecedent and he is in custody since 12.11.2016.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-

Patna High Court Cr.Misc. No.12776 of 2017 (3) dt.28-03-2017 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rail, Samastipur/Successor Court, in connection with Darbhanga (Sitamarhi) Rail P.S. Case No.98 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
