23-04-2018 Heard Sri Manish Kumar No. 13, learned counsel for the petitioner and learned Addl. Public Prosecutor. Two petitioners, apprehending their arrest in Karakat P.S. Case No. 228 of 2017 registered for offence under Sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail in the event of their arrest or surrender.
Learned counsel for the petitioners has drawn my attention to fact disclosed in the F.I.R. and submits that petitioners' name has come in the confessional statement of coaccused, otherwise, there is no other material to connect the petitioners in the present case. Besides this, learned counsel for
Patna High Court Cr.Misc. No.23571 of 2018(2) dt.23-04-2018 2/2 the petitioners has also referred to statement made in paragraph - 3 of the petition to show that petitioners are having clean antecedent.
Considering the fact that petitioners' name has come in the confessional statement of the co-accused as well as they are having clean antecedent, in the event of arrest or surrender within a period of six weeks from today, let both the petitioners namely Bhola Paswan @ Bhola Prasad and Babula Paswan @ Bablu Paswan @ Birendra Paswan @ Bablu be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Addl. District and Sessions Judge cum Special Judge, Excise, Rohtas, Sasaram in connection with Karakat P.S.
