The petitioner seeks bail in a case registered under Sections 341, 448, 323, 342, 427, 354(B), 376, 511/34 of the Indian Penal Code and 3/6 of Protection of Children from Sexual Offences Act.

Allegation is that the accused persons tried to establish physical relation with the victim.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.03.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has remained in custody for more than three months. Due to village politics the petitioner

Patna High Court CR. MISC. No.50483 of 2019(2) dt.14-08-2019 2/2 has been made accused in the present case. The allegation made in the F.I.R. is denied by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, POCSO Act, Muzaffarpur in connection with Trial No.27 of 2019 arising out of Kudhani P.S. case No.147 of 2019.
