The petitioner seeks bail in Muffasil Motihari P.S. Case No. 26/2017, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act, 2016.

The police raided a place, on information that petitioner and others were selling country-made liquor. Two persons namely, Apu Sah and Manoj Kumar were apprehended. 42 pieces of each containing 180 ml. of Nepal Sofia liquor in a plastic bag was recovered. The petitioner was not apprehended at the spot and nothing has been recovered from the possession of the petitioner. The petitioner is in jail since 31.01.2017.

No.10969 of 2017 (2) dt.07-03-2017 Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Muffasil Motihari P.S. Case No. 26/2017.
