He was appointed to the post of Panchayat Secretary in the year 1989. He retired from the service on attainment of age of superannuation on 31st March 2015. The grievance of the petitioner is that he did not get his 2nd ACP, which the Government employee is entitled to get. Though, the petitioner got his 1st ACP in light of the letter no. 2015 dated 18.05.2009 issued by Panchayati Raj Department Bihar, Patna but did not get his 2nd ACP. He made a representation before the District Magistrate, Bhojpur at Ara, alleging his grievance (Annexure 4) for the grant of 2nd ACP, but the said representation remained

Patna High Court CWJC No.11892 of 2024(2) dt.12-08-2024 2/2 unanswered.

2. It is further submitted by the learned counsel for the petitioner that the other similarly situated panchayat secretaries have already got the said benefits, but he has been deprived of the same.

Without going into the merits of the application, this Court directs the District Magistrate, Bhojpur at Ara, to dispose of the petitioner's representation (Annexure-4) within 30 days from the date of communication of this order after giving the petitioner the the petitioner the opportunity of being heard.

4. In view of the aforesaid circumstances, the instant writ petition is disposed of.

5. Let a copy of this order be served to the District Magistrate, Bhojpur at Ara, by the petitioner obtaining a server copy of the same.
