This is a petition for grant of regular bail for offence under Section 30(a) of the Bihar Excise (Amendment) Act, 2016.

Four liters of country made liquor was recovered from the possession of the petitioner. The petitioner has sated on oath that he has got no criminal antecedent and is in custody since 31.12.2016. The petitioner undertakes not to indulge in such type of offence in future.

The petitioner would file affidavit of the aforesaid assertion that he would not indulge in such type of activity in future at the time of furnishing bail bond. Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection

Patna High Court Cr.Misc. No.13209 of 2017 (2) dt.22-03-2017 2/2 with Belhar P.S. Case No. 382 of 2016 to the satisfaction of Shri A.K. Gupta, Sub Judge III-cum-Additional Chief Judicial Magistrate, II, Banka, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case and if the Court below would come to notice that the petitioner has committed similar type of offence in future, the Court below shall be at liberty to cancel the bail bond of the petitioner in this case also.
