JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-05-2017 The petitioner seeks regular bail in connection with Chakia P.S. Case No. 285 of 2016, registered for offences punishable under sections 272, 273, and 290 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act. Allegation against the petitioner is recovery of 10 litres of country made liquor.

It has been submitted that he has no criminal antecedent and has falsely been implicated in this case and has remained in custody for about six months.

Having heard both sides, in view of the facts that he has no criminal antecedent and has remained in custody for about

No.21594 of 2017 (3) dt.12-05-2017 2/2 six months, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihar, in connection with Chakia P.S. Case No. 285 of 2016, Tr. No. 1448 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without obtaining prior permission from the court concerned, the prosecution is free to move for cancellation of his bail.
