JUSTICE SUDHIR SINGH ORAL ORDER 22-03-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The present application has been filed for modification of order dated 18.01.2018 passed in Cr. Misc. No. 2625 of 2018 by which the petitioner was granted anticipatory bail in connection with Muffasil P.S. Case No. 181 of 2017, pending in the court of learned Additional Sessions Judge-VIIth-cum-Special Judge (Excise), Aurangabad. The petitioner was directed to surrender in the court below within a period of six weeks from the date of order dated 18.01.2018 and furnish bail bond.

Learned counsel for the petitioner submits that due to typing mistake, the petitioner's alias name, his father's alias name and village name was not typed in the main bail petition. He further submits that due to some unavoidable reason, the petitioner

Patna High Court Cr.Misc. No.13623 of 2018 (2) dt.22-03-2018 2/2 could not surrender in the court below in time and furnish bail bond.

Considering the aforesaid facts and circumstances, let at the top of the order dated 18.01.2018 passed in Cr. Misc. No. 2625 of 2018, the petitioner's name and address be read as ' Baleshwar Sao @ Baleshwar Sahu @ Baleshwar Kumar Sah @ Baleshwar Kumar, S/O Sri Krishna Sao @ Krishna Sahu, R/O Line MohallaDevi Mandap (Kishunpur), Chatra, P.S. and District-Chatra (Jharkhand)' in place of ' Baleshwar Sao, S/O Sri Krishna Sao, R/O Line Mohalla-Devi Mandap Chatra, P.S. and District-Chatra'. Six weeks' further time is also granted to the petitioner to surrender and furnish bail bond in the court below. The order dated 18.01.2018 passed in Cr. Misc. No. 2625 of 2018 is modified to the extent as indicated above. The modification application is allowed.
