The Petitioner seeks cancellation of bail granted to the Opposite Party by an order dated 17.1.2013 passed by the Sessions Judge, Darbhanga, in B.P. No. 17 of 2013 arising out of Bahadurpur P.S. Case No. 359 of 2012 on the ground that once again, the Opposite Party has indulged in similar activity. The counsel for the Opposite Party is unable to explain his stand.

In view of a clear-cut case where the Opposite Party appears to have misused the privilege of bail, the application is allowed and the bail granted to the Opposite Party in connection with B.P. No. 17 of 2013 arising out of Bahadurpur P.S. Case No. 359 of 2012 by the Sessions Judge, Darbhanga, is hereby,

Patna High Court Cr.Misc. No.5943 of 2015 (3) dt.06-11-2015 2/2 cancelled.

The Trial Court is directed to take stringent steps for arresting of the Opposite Party.
