JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-01-2017 Heard learned counsel for the petitioner and the learned counsel for the Opposite Party No.2.
This application has been filed in connection with Siwan Mahila P.S.Case No.178 of 2015 for the offence under Sections 498A, 504, 506 & 406 of the Indian Penal Code. After some argument, learned counsel for Opposite Party No.2 has submitted that she is still ready to live with her husband, however, the petitioner has raised some objection but later on he became ready to keep the Opposite Party No.2, if she desires to live with the petitioner.
In view of the aforesaid facts, let the petitioner surrender on 10th of February, 2017 before the learned court below and on that day, the Opposite Party No.2 will also be present in the court
Patna High Court Cr.Misc. No.54626 of 2016 (3) dt.30-01-2017 2/2 below and the petitioner will take Opposite Party No.2 to his house and in the meantime, the learned court below will enlarge the petitioner on provisional bail on his own satisfaction and further will watch the conduct of both the parties for a period of six months and if it is found that they are living happily, the learned court below will confirm the bail bond of the petitioner. In the meantime, no coercive steps will be taken against the petitioner.
With the above observation, this application is disposed of.
