JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-06-2018 The present writ application has been filed by the petitioner for a direction to the respondents to enhance the age of superannuation from 62 to 65 years in view of the amendment in Bihar State Rules.

The issue with regard to enhancement of age of superannuation has been decided by the Apex Court in the case Jagdish Prasad Sharma vs. State of Bihar & Ors. reported in 2013 (3) PLJR (SC) 278.

In view of the above, the present writ application is disposed of with direction to the respondents to work out the

Patna High Court CWJC No.10844 of 2011(3) dt.21-06-2018 2/2 entitlement of the petitioner, treating the age of superannuation as 65 years. From the pleading, it appears that the petitioner was 62 years of age in the year 2011 and as such he must have completed the age of retirement of 65 years in the year 2015 itself, the respondents are supposed to take decision extending such benefit of enhancement of age of superannuation in the light of the judgment of the Apex Court in the case of Jagdish Prasad Sharma(Supra).

With the aforesaid, the writ petition stands disposed of .
