This is a petition for grant of anticipatory bail for offence under Section 366 of the Indian Penal Code. Allegation against the petitioner and others is that they kidnapped to Sabrin Khatoon, a minor girl, for illicit purpose. The case diary would reveal that the victim is still missing. Submission of the petitioner is that there is no eye witness of occurrence of kidnapping and false allegation is there. Considering the fact that the victim is still missing and investigation is still going on, I am not inclined to grant anticipatory bail to the petitioner.
The prayer for anticipatory bail is rejected in connection with Goroul P.S. Case No. 199 of 2016 pending in the Court of Subdivisional Judicial Magistrate, Vaishali at Hajipur. (Birendra Kumar, J) SA/- U √ T √
