2. The petitioner in this application prays for grant of anticipatory bail apprehending his arrest in connection with Bariyarpur P.S. Case no. 104 of 2023 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, on a search being conducted 253 litres of liquor was recovered from the two vehicles in question while the accused persons managed to escape.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The only material against the petitioner is that one of the accused who was caught, disclosed that the petitioner was amongst the two persons who managed to escape. The case of the petitioner

Patna High Court CR. MISC. No.62613 of 2025(2) dt.24-09-2025 2/2 stands on a similar footing to that of coaccused Amit Kumar who has been enlarged on bail vide order dated 23.7.2025 passed in Cr.Misc. no. 50055 of 2025. The petitioner has no criminal antecedent and undertakes to cooperate in the investigation/trial.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R., the petitioner not having any concern with the vehicle from which the alleged seizure is said to have taken place, grant of bail to coaccused Amit Kumar vide aforesaid order dated 23.7.2025 and the petitioner not having any criminal antecedent, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bariyarpur P.S. Case no. 104 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise I, Munger.
