JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Dumaria P.S. Case No.40 of 2016 registered for the offences under Sections 147, 148, 149, 341, 504, 323, 324, 307, 325, 302, 448 and 380 of the Indian Penal Code.

There is allegation in the written report that this petitioner along with twenty other persons assaulted the father and uncle of the informant and other family members on account of which father and uncle of the informant died. Learned counsel for the petitioner submits that post mortem report of both the deceased apparently falsifies the allegation as mentioned in the F.I.R.

The petitioner is in custody since 16.08.2016. Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati at Gaya, in Dumaria P.S.
