1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 115, 126(2), 109, 303(2), 351, 3(5) of the Indian Penal Code.

3. The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 07.09.2024 at 7.30 A.M. while he was sitting at his door with his three sons when the accused persons came and started pressurizing to give their share of land. On protest, Bhim Rai gave orders to kill, on which Bablu Rai

Patna High Court CR. MISC. No.52680 of 2025(2) dt.27-08-2025 2/3 assaulted the informant by an iron rod causing injury on head, ear and left hand. Thereafter, the son of the informant Chandrashekhar came to rescue him, when Arjun assaulted him by an Axe causing injury on head and Suresh Rai assaulted him by an iron rod. Thereafter, all the accused assaulted them.

4. The learned counsel for the petitioners submits that on account of dispute relating to land, an altercation had taken place in which both sides assaulted each other. It is next submitted that petitioners are alleged to have assaulted the son of the informant by axe causing injury. It is further submitted that from perusal of the injury report of the son of the informant annexed as Annexure- P/3/1, it would manifest that the injury is simple which amply demonstrates that petitioners never had any intention of committing a serious occurrence. It is also submitted that petitioners are not criminals.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs.

No.52680 of 2025(2) dt.27-08-2025 3/3 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-14, Vaishali at Hajipur in connection with Jurawanpur P. S. Case No.160 of 2024, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
