ANJANA MISHRA ORAL ORDER 09-04-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Jalalpur P.S. Case No. 94/2017 registered for the offences punishable under Sections 323/379/420/467/468/409/506 of the Indian Penal Code. Learned counsel for the petitioners submits that only because they are the brothers and sister of the main accused, the petitioners are facing prosecution. It is further submitted that these petitioners have also invested money in the fund and, if at all, there was any misappropriation, the petitioners will also be prejudiced by the same. It is next submitted that for the same reason the entire family has been roped into the present case on account of the act of the main accused Ram Singh.

No.16576 of 2018 (2) dt.09-04-2018 2/2 Having considered the facts and circumstances of the case and that the petitioner No. 1 and 2 are the younger brothers of the Ram Singh and petitioner No. 3 is the sister who have no concern with the business of the Ram Singh, let the petitioners abovenamed in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Jalalpur P.S. Case No. 94/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
