The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 and 120B of the Indian Penal Code.
The informant filed Complaint Case No. 20 of 2011, alleging therein that he deposited Rs. 40,000/- in the name of his wife Sangita Kumari and Sanjay Kumar. The insurance was for ten years and the informant received receipts of the bonds, but thereafter OCPL company was closed.
It is submitted that the petitioner is managing director of the company, he was sitting at Kolkata. The petitioner neither collected money nor there is any paper to show that the money was deposited in the company of the petitioner. Many agents filed
Patna High Court Cr.Misc. No.8194 of 2015 (6) dt.24-11-2015 2/2 several cases and the petitioner has already been enlarged on anticipatory bail in different cases vide orders passed in Cr. Misc. No. 16064 of 2015, Cr. Misc. No. 18970 of 2015 and Cr. Misc. No. 18973 of 2015. The content of the complaint petition is almost similar in all the cases. The petitioner has been arrayed as an accused, but no specific allegation is made against him.
Having considered the facts aforesaid and the fact that the petitioner neither received any money nor gave any receipts and has already been enlarged on anticipatory bail in different cases of similar nature, the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Aurangabad Town P.S. Case No. 85 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
