JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Ladaniya P.S. Case No. 90 of 2019 for the offence under Sections 341, 323, 498A and 313 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 24.05.2019.

Petitioner is the husband of the informant. It appears that the petitioner and the informant have joined love marriage. In the instant case, case diary was called for. From the case diary it appears that there is no allegation of demand of dowry and torture by the petitioner.

Considering the aforesaid, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is

Patna High Court CR. MISC. No.52650 of 2019(4) dt.03-02-2020 2/2 directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.- IV, Jhanjharpur, District Madhubani in connection with Ladaniya P.S. Case No. 90 of 2019.

After release of the petitioner, the court below shall refer the husband and wife to the District Mediation Centre, Madhubani for amicable resolution of the dispute. (Anil Kumar Upadhyay, J) BT/- U T
