====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 05-10-2024 Heard learned Counsel for the petitioner and learned APP for the State.
2. The petitioner is apprehending arrest in connection with Dhansoi P.S. Case No. 62 of 2024, registered on 08.05.2024, for the offences punishable under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against two named accused persons including the present petitioner against whom there is allegation that the petitioner and other coaccused reached at the Informant's house and started abusing that why he used to talk with his bhabhi. It has been further alleged that both the accused persons have attacked on the head of the informant by danda, causing head injury and snatched the gold chain.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that it has been indicated in the FIR itself that the dispute
Patna High Court CR. MISC. No.57699 of 2024(3) dt.05-10-2024 2/2 is related to the agricultural land and the dispute is going on between the family of Akhilesh Singh, having two wives. Counsel submits that there is a case and counter case for the same date and place of occurrence which is annexed as Annexure- P/2 (Complaint Case No. 481 of 2024). Counsels submits that the coaccused has already been granted anticipatory bail by this Court vide order dated 21.08.2024 passed in Cr. Misc. No. 51433 of 2024. Counsel also submits that antecedent of the petitioner is clean.
5. Learned APP for the State opposes the prayer for bail.
6. In the present facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Buxar, in connection with Dhansoi P.S. Case No. 62 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
