2. The petitioner seeks bail in connection with Garkha P.S. Case No. 333 of 2024 dated 11.06.2024 instituted for the offence punishable under Sections 147, 149, 341, 323, 324, 354, 379, 504 of the Indian Penal Code.

3. The prosecution case, in short, is that on the alleged date of occurrence, the petitioner and other accused persons armed with lathi, danda, knife and sword surrounded the informant and his brother, namely, Ramdutta Rai and started assaulting them due to which he became seriously injured. 4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that the petitioner and the informant is the full brother. There is land dispute between them. There is no specific allegation against the petitioner rather the allegation against the petitioner is general and omnibus. It is submitted that other similarly situated person has been granted bail by the learned Sessions Court. The petitioner's bail application has been rejected by the lower court only on the ground that the petitioner concealed the criminal antecedents stating that he has one criminal case. Learned counsel for the petitioner submits that, in fact, the petitioner had no knowledge about another case bearing Garkha P.S. Case No.

151 of 2025 which was registered on 07.03.2025 after the institution of the present F.I.R. The present F.I.R. was lodged on 11.06.2024. Learned counsel for the petitioner further submits that as per F.I.R., six persons including the petitioner have assaulted the informant due to which he sustained injuries but as per the injury report, only one injury was found on the body of the informant. Lastly, it has been submitted that the petitioner is in custody since 20.05.

5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the prayer for bail of the petitioner. Learned counsel for the informant submits that in this incident, the informant has sustained grievous injury.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Saran at Chapra in connection with Garkha P.S.
