The petitioner is apprehending his arrest in connection with Jandaha P.S.Case no.179 of 2017 registered for offences punishable under Sections 379 of 34 of the Indian Penal Code. Petitioner is named in the FIR and there is allegation of snatching of motorcycle.

Submission of the learned counsel for the petitioner is that the main allegation is against three accused persons and the name of the petitioner has been disclosed by co-accused and nothing has been recovered from his possession and he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.24287 of 2018 (2) dt.03-05-2018 2/2 circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court, if possible on the same day.
