The petitioner seeks bail in Cheria Bariyarpur P.S. Case No. 76 of 2020 corresponding to Sessions Trial No. 251 of 2021, registered for the offence punishable under Section 302, 307 and other allied sections of the Indian Penal Code. Earlier the bail application of petitioner was rejected vide order dated 16.06.2021. Vide order dated 17.11.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'R'), which reveals that due to nonappearance of rest seven accused persons case is still running for evidence.

Considering the nature of accusation and stage of

Patna High Court CR. MISC. No.64192 of 2021(3) dt.12-01-2022 2/2 trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, trial court is directed to conclude the trial as early as possible.
