2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 201, 34 of the Indian Penal Code.

3. As per prosecution case, it is alleged that the petitioner is indulged in hatching conspiracy to kill the deceased Puja Kumari in connivance with other accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case at the instance of his enemies. No one is eye witness of the alleged occurrence. Except suspicion, nothing has come against the petitioner in the present case. During investigation, it has come that one Yugesh

No.58014 of 2023(3) dt.03-11-2023 2/2 Yadav has been killed in train accident with whom deceased Puja Kumar was in love affair and after getting such information, he committed suicide herself. The petitioner is languishing in judicial custody since 10.4.2023. Moreover, similarly situated co-accused namely, Indradeo Yadav has already been granted bail by a co-ordinate Bench of this Court vide order dt. 23.5.2023 passed in Cr. Misc. No. 25531 of 2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Belaganj P.S. Case No. 108 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya.
