2. The petitioner seeks regular bail in connection with the Refinery P.S. Case No. 18 of 2024 registered for the offence under Sections 302/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is alleged to have committed murder of the deceased. Petitioner is in custody since 23.04.2024.
4. The deceased was the roommate of the petitioner. The company officials found him unconscious and they took him to the hospital for treatment where he was declared brought dead.
5. In the post-mortem report, it has come that there were external injury on the neck of the deceased and he died
Patna High Court CR. MISC. No.58627 of 2024(2) dt.28-08-2024 2/2 due to asphyxia. It has also come during investigation that apart from the petitioner, no one was staying in the room with the deceased.
6. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. This application for regular bail is, accordingly, rejected.
7. If the trial is delayed by the prosecution, the petitioner may renew his prayer for bail.
