2. The petitioner apprehends his arrest in connection with Amnour P.S. Case No. 100 of 2025 instituted under Sections 30(a), 33, 34 and 47 of Bihar Prohibition and Excise Act.

3. As per the prosecution case, 640 litres of spirit was recovered from the Bolero Pick-up vehicle bearing Registration No. BR03GA-5297.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that no incriminating article has been recovered from the conscious possession of petitioner. The petitioner has no concern with the seized articles and the said

He further submits that except the disclosure statement made by the co-accused Suraj Kumar, there is no material against the petitioner. Petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Exclusive Special Excise Judge, Saran at Chapra in connection with Amnour P.S. Case No. 100 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
