In this case, the petitioner is apprehending his arrest in connection with Saharsa Sadar P.S. Case No. 469 of 2017 registered for offences under sections 147, 148, 149, 341, 323, 307, 379, 384 of the Indian Penal Code.

An allegation has been made that all the accused persons assembled and started brick batting and assaulted the persons of the Informant's side. Specific allegation has been made against Sunil Ram who has caused injury by rod over the head of the Informant.

Learned counsel for the petitioner has submitted that there is no specific allegation against the petitioner rather it is

Patna High Court Cr.Misc. No.6169 of 2018 (2) dt.05-02-2018 against Sunil Ram of assaulting the Informant. Looking to the entire facts and circumstances of the case, let the petitioner, namely, Ashok Ram, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 469 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
