The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147/148/341/323/379/504/506 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the accused persons snatched Rs.20,000/- from the informant and gave life threatening also. It is submitted by learned counsel for the petitioners that accusation is only specific against petitioner no.1 Md. Aazam and even assuming the accusation no offence under

Patna High Court Cr.Misc. No.53950 of 2015 (2) dt.27-11-2015 2/2 section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act is made out. It is further submitted that in fact when the petitioners protested the illegal activity of the informant being PDS dealer, the present case has been lodged against them.

Considering the fact that the investigation has concluded and petitioners have been chargesheet, it is a case for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Palasi P.S. Case No.219 of 2014, pending before the learned Judicial Magistrate, 1st Class, Araria.

With the above observation, this application is, accordingly, disposed off.
