JUSTICE SANJAY PRIYA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Vijaipur P.S. Case No. 47 of 2016 instituted for the offence under Sections 341, 323, 315, 504, 34 of the Indian Penal Code.

It is alleged that the petitioner with other accused persons assaulted the pregnant wife of the informant on account of which her eight months pregnancy got aborted. It is submitted that both the parties are agnates. It is further submitted that a compromise has taken place between the parties and the compromise petition has also been filed. In the impugned order also, it is mentioned that compromise has taken place with the wife.

The District and Sessions Judge has mentioned in the

Patna High Court Cr.Misc. No.8859 of 2017 (2) dt.20-03-2017 2/2 impugned order that Gynecologist has reported that the victim girl delivered a male baby (I.V.D.) because of injury and heavy bleeding.

The petitioner is in custody since 21.12.2016. Considering the aforesaid facts and circumstances, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Vijaipur P.S. Case No. 47 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
