2. This writ application has been filed for issuance of direction to the respondents to appoint the petitioner as Assistant (Vidyalaya Sahayak) on compassionate ground and to grant all other consequential benefits to the petitioner.

3. Having regard to the statements made in paragraphs '6' and '7' of the counter affidavit filed on behalf of the Respondent Nos. 4 and 5 which are being reproduced hereunder, this Court directs the concerned Respondent No. 7 that as soon

Patna High Court CWJC No.14279 of 2022(3) dt.14-09-2023 2/2 as the vacancies are available, the list of all the candidates who have been waiting for appointment on compassionate ground must be moved and all endeavours be made to fill up the vacancies available for appointment on compassionate ground. "6. That it is respectfully stated and submitted that the answering respondent has issued letter no. 1331 dated 20.07.2023 to Chief Executive Officer Zila Parishad Nawada for appointment of 21 candidates including the petitioner to appoint them on compassionate ground.

7. That it is respectfully stated and submitted that at present time there is no any vacancy is available in Zila Parishad Nawada for the post of school Assistant/Parichari. Hence as soon as the vacancy will available the petitioner will be appointed."

The purpose behind appointment on compassionate ground is to provide immediate succour to the family of the deceased employee who died in harness, therefore, this Court expects that the District Board shall be sensitive towards the need of appointment of the people who are waiting in the list. 5.This writ application stands disposed of accordingly.
