The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,307,458,380 and 306/34 of the Indian Penal Code and sections 25(1-B) a, 26, 27 and 35 of the Arms Act. The prosecution case is that three FIR named accused persons including the petitioner entered into the house of the informant when daughter in law of the informant woke up, the accused persons were asking about some documents with regard to land. The accused persons broke the mobiles by throwing them on the ground and took away jewellery. The petitioner is alleged to
Patna High Court Cr.Misc. No.53424 of 2015 (2) dt.24-11-2015 2/2 have fired from pistol but the pistol fell while he was escaping from the place of occurrence.
It is submitted by the learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Aungari P.S. Case No. 12 of 2014 pending in the court of learned CJM, Nalanda. This application is disposed of with the aforesaid observation/direction.
