Petitioners apprehend arrest in connection with Complaint Case No. 1611 of 2015 registered under Sections420, 467, 468/34 of the Indian Penal Code. The allegation against the petitioners is that they fraudulently got the land of the complainant sold by the complainant in favour of petitioner no. 1.
Learned counsel for the petitioners submits that petitioner no. 1 purchased the land from the complainant after completing due formalities. It is further submitted that
Patna High Court Cr.Misc. No.53909 of 2016 (3) dt.12-01-2017 2/2 petitioner no. 2 is only the witness of the sale deed. It is further submitted that the allegations as levelled in the complaint is purely civil in nature.
Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Complaint Case No. 1611 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
