2. In this case, the petitioner is seeking regular bail in connection with Dehri (T) P.S. Case No. 796 of 2018, registered for the offences punishable under Sections 302, 34 of the IPC.

3. According to allegation, co-accused Ram Avatar Dom assaulted on head of the deceased with iron rod. The allegation against other co-accused persons, including the petitioner, is that they assaulted the deceased with stick and brick bats.

4. By drawing my attention towards deposition of the informant, who examined as PW-2, the learned counsel for the petitioner has submitted that the informant did not support the prosecution case, neither he named any accused persons. Similarly, PW-1 also did not support the allegation and he turned hostile.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Rohtas at Sasaram in connection with Dehri (T) P.S. Case No. 796 of 2018, G.R. No. 995 of 2018 subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

7. The petitioner shall physically appear before the learned court below on each and every date. In case of failure on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bonds of the petitioner.
