The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 452, 341, 323, 325, 307, 504, 506, 379, 427/34 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The accusation is of entering into the house and making assault to the informant and when the wife of the informant came to rescue she was also assaulted. It is submitted by learned counsel for the petitioner that the specific accusation of assault is against coaccused Rahul and accusation of assault is omnibus and general against the petitioner. A statement has been made in paragraph 3

Patna High Court Cr.Misc. No.53603 of 2015 (2) dt.26-11-2015 2/2 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Nabinagar P.S. Case No. 96 of 2015 pending in the court of learned Additional Chief Judicial Magistrate, Aurangabad.

With the aforesaid observation, this application is disposed of.
