JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Kajra P.S.Case No. 10 of 2015 for the offences under Sections 379/414 of the Indian Penal Code.

From FIR it transpired that three persons were apprehended on 15.02.2015, who disclosed the name of the petitioner and others in theft of the motor cycles. One Dhirendra Kumar, who was apprehended at the spot, has been granted bail vide order dated 31st August, 2015 in Cr. Misc. No. 36984 of 2015. Another co-accused, namely, Govind Kumar @ Govind Rai has also been granted bail vide order dated 19.05.2017 in Cr. Misc. No. 22812 of 2017. The petitioner is in custody since 03.10.2016.

No.11719 of 2017 (4) dt.31-05-2017 2/2 Having regard to the period of custody and the fact that other co-accused have been granted bail, as mentioned above, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Aditya Kumar Singh, learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Kajra P.S.Case No. 10 of 2015 on the condition that he will extend full co-operation in the trial and will not, in any manner, influence the witnesses or the evidence.
