JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/307/506 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the petitioner came to the house of the informant and started abusing. On protest being made the petitioner fired on the grand-son of the informant but no injury was caused to him as he entered into the house. Thereafter, the petitioner fired on the informant caused injury on her thigh.
It is submitted by learned counsel for the petitioner that that the injury report of the informant, Dhano Devi, brought on record, as annexure-2, reflects penetrating would on the right thigh communicating to each other caused by sharp object, found to be
Patna High Court Cr.Misc. No.54189 of 2015 (2) dt.30-11-2015 2/2 simple in nature. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation being not corroborated with the medical opinion, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda at Biharsharif in connection with Manpur P.S. Case No.94 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
