====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL ORDER 01-04-2015 Heard learned Counsel for the petitioner and the State. The petitioner seeks cancellation of bail of the Opposite Party on the ground that after release on bail by order dated 28.1.2010 vide Cr. Misc. 1423 of 2010 in connection with Rajiv Nagar P.S. Case No. 58 of 2009, the Petitioner has committed yet another offence i.e. Gandhi Maidan P.S. Case No. 205 of 2010 whereas at the time of granting bail to the Petitioner in Rajiv Nagar P.S. Case No. 58 of 2009, a condition had been imposed that he would be implicated in any other case of similar nature, his bail bond would liable to be cancelled.
Notices had been issued to the Opposite Party but none appeared on his behalf.
Having considered the factual aspects of the case,
Patna High Court Cr.Misc. No.19451 of 2013 (6) dt.01-04-2015 2/2 evidently, in my opinion, that the Opposite Party has misused the privilege of bail and the same deserves to be cancelled. Hence, the bail bond of the Petitioner in connection with Rajeev Nagar P.S. Case No. 58 of 2009 is hereby cancelled. The Trial Court is directed to take immediate and stringent steps for ensuring the arrest of the Opposite Party. (Anjana Prakash, J) S.Ali/- U T
