The petitioner has renewed his prayer for grant of bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The earlier application for bail of the petitioner was rejected vide order dated 26.04.2022 passed in Cr. Misc. no. 67024 of 2021.

As per the prosecution case, 50 litres of liquor was recovered from the motorcycle belonging to the petitioner. It is submitted by learned counsel for the petitioner that the petitioner is in custody since 10.9.2021 and there is no progress in the trial in the learned trial court. No.54762 of 2022(2) dt.02-11-2022 2/2 taking into consideration the liberty granted to the petitioner in the earlier order of rejection dated 26.4.2022 together with the petitioner having remained in custody for more than 1 year since 10.9.2021, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.5639 of 2021 (arising out of Bihta P.S. Case no.667 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna.
